Democrats’ victory in the U.S. Senate will transfer control of the federal judicial confirmation process when the new Congress begins on January 3, changing the path for President Donald Trump’s future court nominees.

The Associated Press reported that Democrats secured control of the chamber in Tuesday’s midterm elections, winning at least 54 seats. The majority party controls the Senate Judiciary Committee’s agenda and determines which judicial nominations reach confirmation votes on the Senate floor.

Republicans will retain their current Senate majority through the end of the year. That leaves a lame-duck period in which they can continue acting on Trump nominees already awaiting committee or floor consideration.

The Judiciary Committee has scheduled an executive business meeting for November 10 with six district-court nominees on its agenda. A separate nominations hearing is scheduled immediately afterward, according to the committee’s official calendar.

Reuters reported Wednesday that 56 federal judges have been confirmed since Trump returned to office in January 2025. The report said 13 nominees have already appeared before the committee and nine more are pending before it, including candidates for federal appeals courts.

Once Democrats take control, the White House will need support from the new majority to advance nominees. That does not automatically prevent all confirmations. District-court candidates can move through the Senate when the administration and senators reach agreements, but the incoming majority will decide whether to hold hearings, report nominees from committee and schedule final votes.

Rhode Island Sen. Sheldon Whitehouse is positioned to chair the Judiciary Committee after Illinois Sen. Dick Durbin retires, Reuters reported. Formal committee leadership and membership will be set by the next Congress.

The change affects future nominations and pending vacancies; it does not alter the status of judges already confirmed. Republicans can still act on nominees before January, and the final number completed in the current Congress will depend on the committee and floor schedule during the remaining session.
