The Office of the Comptroller of the Currency issued its first supervisory framework Wednesday for examiners evaluating how national banks and federal savings associations use advanced artificial intelligence systems.

The nonbinding guide tells examiners to assess the potential consequences of a bank’s AI use rather than treating the technology as a separate category of risk. It says the intensity of controls may need to increase when an AI agent has greater autonomy or when failure or misuse could have more serious effects.

The OCC uses the term “super intelligence” for technologies previously described as artificial intelligence, including rapidly advancing agentic systems. Its framework applies to normal-course banking activities and is meant to supplement existing reviews of governance, compliance, technology, model risk and operational risk.

Banks are not required to create a separate AI risk appetite under the framework. Examiners should tailor their work to the bank’s size, complexity and risk profile, as well as the nature, autonomy and possible consequences of the specific use case.

That means a relatively simple system allowed to initiate transactions could warrant closer scrutiny than a more technically sophisticated model used internally without decision-making authority. The guide emphasizes the transfer of agency and the degree of human oversight rather than model complexity alone.

The OCC said the document does not establish new enforceable standards or supervisory expectations for banks. It is an examiner resource, and the agency plans to update it as technology, banking use cases and supervisory understanding evolve.

The framework matters because banks are expanding their use of generative and agentic systems while regulators weigh cybersecurity, financial-stability and consumer-protection risks. Reuters reported that authorities have increasingly asked lenders how they monitor advanced models, constrain autonomous actions and respond to errors.

The OCC’s technology-neutral approach leaves existing safety-and-soundness and legal obligations in place. The agency said bank activities must remain safe, sound and consistent with applicable laws regardless of whether they use traditional systems or newer AI tools.
