Launch Catch-Up — Proposed Rule Published October 26, 2026

The Treasury Department published proposed outbound-investment regulations October 26 to implement provisions of the Comprehensive Outbound Investment National Security Act.

The proposal would require U.S. persons to notify Treasury about certain transactions involving foreign entities engaged in specified technologies and prohibit other covered transactions. Written comments are due December 7.

The notice describes a new regulatory part alongside the existing Outbound Investment Security Program. Earlier rules, effective January 2, 2025, address specified semiconductor, quantum-information and AI activities involving countries of concern.

Treasury says the proposed framework incorporates existing definitions where consistent with the statute and would establish applicability dates so earlier rules continue to govern transactions during their relevant period.

The October 26 document is a proposal, not a final rule putting every suggested change into effect immediately.

The notice opens a public rulemaking process. It does not determine whether a particular person's investment is covered, exempt or prohibited; those questions depend on the relevant rules and transaction facts.
